1.PARTIES

Seller Information (Hereinafter referred to as “Seller”)

Buyer Information (Hereinafter referred to as “Buyer”)

2. CONTRACT SUBJECT AND DEFINITIONS

a. This distance selling contract (“Contract”) covers the rights and obligations of the parties regarding the sale of Product(s) detailed in section 3, in accordance with Law No. 6502 on Consumer Protection (“TKHK”) and the Distance Contracts Regulation dated 27/11/2014 (“Regulation”).

The Buyer acknowledges that they have been provided with comprehensive pre-information by the Seller, including but not limited to: name, title, clear address, telephone and other contact details, basic product characteristics, total price including taxes, payment method, delivery and return conditions, associated costs, instructions for exercising the right of withdrawal, and information about official channels for complaints and objections. The Buyer confirms that this information was presented clearly, comprehensibly, and in a manner suitable for online platforms. The Buyer declares that they have electronically approved this pre-information and subsequently placed a product order in accordance with the terms of this Contract.

b. The subject of this Form is the order (“Product(s)”) placed by the Buyer through the Seller’s (“CNT”) electronic commerce website (“Website”). As stated in various parts of the Website where the sale is made, the Product(s) are second-hand. CNT’s commitment is limited to the originality of the Product(s).

c. The company/personal details of the Buyer and Seller are specified above. It is importantly noted that this Contract is valid only for contracts where the Buyer has consumer status, and general provisions will apply for contracts where one party is not a consumer.

3. CONTRACT PRODUCT(S)

4. PAYMENT AND DELIVERY CONDITIONS

a. Orders will be processed within 48 hours/2 business days after payment confirmation. Orders placed after 4:00 PM, on holidays, and official holidays will be processed the next business day. The Buyer will be informed in case of any potential delay.

b. Payment can be made via credit card/bank card or bank transfer/EFT. Orders not fully paid within 1 hour of delivery will be canceled. The responsibility for ensuring complete and full payment lies with the Buyer.

c. Shipping costs will be borne by the Buyer or Seller based on the total order amount. When shipping costs are the Buyer’s responsibility, the shipping fee is included in the total. Deliveries will be made through the cargo company selected by the Buyer (if shipping is at Buyer’s expense) or a cargo company chosen by the Seller (if shipping is at Seller’s expense).

e. Product(s) will be delivered within a maximum of 7 business days from the order confirmation email or notification and contract establishment.

5.RIGHTS AND OBLIGATIONS OF PARTIES

a. The Buyer acknowledges having read and examined the preliminary information on the website www.authenticseconds.com regarding the product’s essential characteristics, sales price, payment method, and delivery details. The Buyer confirms having full knowledge of these details and providing the necessary electronic consent.

b. By electronically approving this Contract, the Buyer confirms that they have received complete and accurate information from the Seller, including:

• Delivery address
• Telephone number
• Basic product characteristics
• Product price (including taxes)
• Payment and delivery information
• Withdrawal rights details.

c. Prior to accepting delivery, the Buyer shall inspect the product. The Buyer will not accept products that are:

• Bruised
• Broken
• Have damaged packaging, etc.

If damage or defects not apparent during delivery are discovered after receipt, the Buyer shall immediately notify the Seller via email at info@authenticseconds.com.

d. The Buyer guarantees the accuracy of all information provided during the contract process. The Buyer bears full responsibility for any inaccuracies and potential damages arising from incorrect information.

Additionally, if the Buyer wishes to return the product, they commit to:

• Not damaging the product or its packaging
• Submitting the original invoice and delivery note to the Seller.

e. Intellectual Property Rights:

All software, source codes, data codes, databases, and their developed versions comprising the www.authenticseconds.com website are exclusively owned by the Seller. These rights include:

Intellectual Property Rights as defined in the Intellectual and Artistic Works Law No. 5846, specifically:

• Article 21: Processing Rights
• Article 22: Reproduction Rights
• Article 23: Distribution Rights
• Article 24: Performance Rights
• Article 25: Public Transmission Rights

Moral Rights include:

• Article 14: Right of Publication
• Article 15: Right of Attribution
• Article 16: Right to Prevent Modifications

Without the Seller’s written and explicit consent, the following are prohibited:

• Copying these software components
• Processing
• Reverse engineering
• Reproducing (fully or partially)
• Distributing
• Transmitting to the public via communication tools
• Using in digital or mobile platforms
• Making available to third parties
• Recording on data storage devices
• Using in audiovisual works
• Modifying, adapting, or translating by current or future methods

Any violation of these rights will result in legal consequences.

6. RIGHT OF WITHDRAWAL

a. The Buyer may withdraw from the contract within 14 days of receiving the Product(s), without stating a reason, without paying a penalty, and without incurring legal or penal responsibility.

However, according to Regulation Article 15(ç), the right of withdrawal cannot be exercised for products related to health and hygiene if their packaging, seal, or protective elements have been opened after delivery.

b. Notification of withdrawal must be made in writing within this 14-day period:

c. If withdrawing, the Product(s) must be returned to the Seller within 14 days via the original delivery cargo company. Return costs will be covered by the Buyer and cannot exceed the original delivery costs. If the Buyer chooses a different cargo company, they will be responsible for all return expenses.

d. If the returned Product(s) show damage or defects caused by the Buyer, the Seller may:

• Reject the withdrawal right
• Accept the withdrawal and request compensation for damages

7. FORCE MAJEURE

a. Force majeure includes unforeseen circumstances outside the parties’ control that existed after contract signing and make it impossible to fulfill contractual obligations, such as:

• Natural disasters
• War
• Terrorism
• Riots
• Legislative changes
• Product recall
• Seizure
• Strikes
• Lockouts
• Significant disruptions in production or communication facilities

The party experiencing force majeure must immediately notify the other party in writing.

b. During a force majeure event:

• Parties are relieved of their contractual obligations
• If the force majeure continues for 10 (ten) days, either party may unilaterally terminate the contract.

c. If product sale becomes impossible due to force majeure, the Seller will:

• Refund all payments
• Refund any delivery costs
• Complete reimbursement within 14 days of notification.

8. DISPUTE RESOLUTION AND FINAL PROVISIONS

a. Consumer Buyers may submit complaints and objections to:

• Consumer Problems Arbitration Committee
• Consumer Court Based on the monetary limits set annually, at the place of purchase or the Buyer’s place of residence.

b. For Buyers not qualifying as consumers, disputes will be resolved by:

• Istanbul Central Courts
• Istanbul Execution Offices

c. The Buyer irrevocably declares and commits that they have read and understood the Form on www.authenticseconds.com, and by clicking the relevant place on the website, they accept the terms.
